Surrogacy in Oregon

Although Oregon does not currently have any laws that specifically regulate surrogacy, the courts have a long history of acknowledging surrogacy agreements and facilitating legal relationships between intended parents and children born through surrogacy. Overall, Oregon is a favorable place to pursue surrogacy, where both the rights of the surrogate and the intended parents are acknowledged and protected.

What is Surrogacy?

A surrogate is typically used when a woman is unable to carry a child due to fertility issues or other health-related complications. Surrogacy is also an option for same-sex male couples wishing to have children genetically related to one or both partners. In gestational surrogacy, a third party carries a child created from the eggs and sperm of the intended parent(s) and/or donor(s) via IVF. The surrogate and child share no genetic relationship.

How does surrogacy work in Oregon?

In Oregon, it is legal to pursue gestational surrogacy and to be compensated for your services. In the eyes of the law, parentage is established through a pre-birth order, which is an agreement that declares the intended parent(s) as the legal parent(s). With a pre-birth order in place, the surrogate and intended parent(s) complete all necessary paperwork before the baby is born, and will most likely not have to appear in court.

Surrogate Requirements in Oregon

To be considered eligible to become a surrogate, potential surrogates are required to meet certain qualifications. These requirements are in place to ensure a safe, healthy, and rewarding journey for everyone involved. At Reproductive Possibilities, some of our requirements for Oregon surrogates include:

  • Having given birth at least once previously (with no medical complications and no more than three c-sections)
  • Being a non-smoker
  • Having a BMI of 18-33
  • Being between the ages of 21 and 44 years old (exceptions may be made for experienced surrogates)

Surrogate Pay in Oregon

Gestational surrogacy requires much time, effort, and energy and therefore surrogates are compensated accordingly. Typically, gestational surrogates in Oregon earn up to $55,000 to $60,000, which includes all compensations, benefits, and reimbursements. A pregnancy with a single fetus will typically yield a base compensation of $35,000, while pregnancy with multiple fetuses will have an additional $5,000. Compensation is generally higher for gestational carriers who have already had a successful surrogacy journey.

How Oregon Surrogates and Parents Are Matched

The surrogacy process begins with you filling out an application and undergoing the screening process. Once this information is processed and you’re accepted into the program, you are ready to be matched with intended parents. To make a great match, Reproductive Possibilities will talk to both the surrogate and the intended parents about their expectations and preferences.

Once we have identified a potential match, our team coordinates a meeting between the surrogate and potential intended parents so that they can discuss various factors, including:

  • Means and frequency of communication
  • Familial and social support systems
  • Perspectives on medical issues, such as pregnancy reduction and/or termination, or carrying multiples

If you and your prospective intended parents come to an agreement during this conversation and decide to move forward, you are considered matched. Congratulations, you are about to begin an incredibly exciting adventure! Throughout the entire process, Reproductive Possibilities will be there to help you and your intended parents navigate your journey.
